STEPBYCOIN USER LICENSE (EULA)

PLEASE READ THIS END USER LICENSE AGREEMENT CAREFULLY. This End User License Agreement (“EULA”) governs your use of the video game, application, software, and their associated upgrades, patches and updates and related services (“Product”) provided or to be provided by any of Stepbycoin subsidiaries or affiliates. This EULA sets out the basis for the way Stepbycoin provides the Products to you (“User” or “You”) and the ways in which You may use them. Stepbycoin's Privacy Policy, available at https://stepbycoin.com/user-agreement/ ("Privacy Policy"), forms an integral part of this EULA. By installing or using the product; You agree to be bound by (1) this EULA and (2) the Privacy Policy. If you do not accept any of these, please do not install or use the Product. Stepbycoin reserves the right to make changes, modifications, additions or deletions to this EULA at any time in accordance with the procedures described in Section 9 below. Capitalized terms used without definition in this EULA shall have the meanings set forth in the Terms of Use.

1. GRANTING OF LICENSE.

1.1 Stepbycoin (or its licensors) grants You a non-exclusive, non-transferable, non-sublicensable, non-commercial and It provides a personal license. Under no circumstances may you use the Product or its License for commercial purposes, or permit others to do so, without obtaining permission from Stepbycoin. Updates, upgrades, patches and modifications may be required to continue using the Product on certain hardware. THIS PRODUCT HAS NOT BEEN SOLD TO YOU; LICENSED. Where applicable, third party functions may be available in certain parts of the Product; Some of these may be managed by third-party providers to which additional terms and/or costs may apply. You must comply with these additional terms. You must comply with the associated wireless data services agreement when using the product. Please review these additional terms and costs carefully.

1.2 You may not, directly or indirectly, (i) sell, rent, lease, license, distribute, market or exploit the Product or any portion thereof; (ii) reverse engineer, decompile, decompile, adapt or reproduce such Product, in whole or in part. or create derivative works (except where the Product allows you to create, produce or submit User Generated Content through a dedicated function, in which cases you will be required to create an Account and comply with the Terms of Use); (iii) create, use and/or distribute any “automatic”, “practical”, “scripted” or “macro” computer programs or other “cheat” or “hack” programs or software applications for this Product (whether through any online or multiplayer game, whether in a single-player game over the Internet or a local area network); (iv) remove, alter or disable any trademark or copyright legends or other developer or origin information, notices or labels appearing on or in this Product. and (v) export or re-export this Product or any adapted copy thereof in violation of any applicable law or regulation.

1.3 When using the Product, you agree to comply with all applicable laws, rules and regulations. You also agree to comply with certain rules regarding your use of the Product (“Rules of Conduct”), which may not be exhaustive and may be changed by Stepbycoin at any time. In all cases, you may only use the Product in accordance with the expected use of the Product.

By way of example, and without limiting Stepbycoin's right to take action against You, You may not:

a) Any use of the Product in any way that violates a duty of confidentiality, infringes any intellectual property right or a person's right to privacy, or encourages any illegal act (in particular piracy, the creation of license-revoking adaptations or the circulation of counterfeit software). create, use, share and/or publish a material (text, word, image, audio, video, etc.);

b) Alter, disrupt, hinder, abnormally aggravate, negatively affect, slow down and/or prevent the normal functioning of all or part of the Product or access to the Product by other users or the operation of the Product's public networks, or attempt to do any of these;

c) To transmit or disseminate any viruses, trojan horses, worms, bombs, corrupted files and/or similar destructive devices or corrupted data relating to the Product and/or to Stepbycoin's servers and/or the Product and/or servers of service providers or partners. organize or in any way participate or interfere with any attack;

d) For example; create, provide or use alternative methods of using the Products for server emulators; to. spamming the chat by disrupting the flow of dialogue with repeated posts of a similar nature, whether for personal or commercial purposes;

e) Language that, in Stepbycoin's sole and exclusive discretion, is, without limitation, hurtful, threatening, unlawful, offensive, abusive, defamatory, degrading, obscene, sexually offensive, or controversial on the basis of race, ethnicity, or other grounds. transmit or post any material or content that is believed or deemed to be objectionable, including the use of

f) Harass or threaten other users of the Product;

g Improperly use the help service or request buttons or submit inaccurate reports to Stepbycoin staff;

h) Claiming to be an employee or representative of Stepbycoin or its partners and/or representatives, although this is not true;

i) Making false claims of endorsement or affiliation with the Product or Stepbycoin.

2. OWNERSHIP.

All title, title and intellectual property rights in and to the Product and any copies thereof (individually or collectively, without limitation, all texts, graphics, music or sounds, all messages or informational items, fictional characters, names, themes, , objects, stage settings, costumes, effects, dialogues, slogans, locations, characters, schemes, concepts, choreographies, videos, audio-visual effects, domain names and other elements that form part of the Product) are the property of Stepbycoin or its licensors. . The Product is protected by national and international laws, copyright treaties and agreements and other laws. Reproduction or presentation of these licensed materials in any form and for any reason is prohibited without the prior consent of Stepbycoin and, where applicable, Stepbycoin's licensors and representatives. Except as expressly set forth in this EULA, all rights not expressly granted to You herein are expressly reserved by Stepbycoin. This License does not grant any title or ownership interest in the Product and should not be construed as a sale of rights to the Product.

3. ACCESS TO THE PRODUCT.

3.1 YOU ACKNOWLEDGE THAT YOU ACKNOWLEDGE, AGREE AND CONSENT TO THE FOLLOWING WITHIN THE CONTEXT OF Stepbycoin. AGE RESTRICTIONS MAY APPLY TO ACCESS ONLINE SERVICES AND FEATURES, CONSISTENT WITH LOCAL LAWS.

3.2 If You are using the Product on a Compatible Mobile Terminal, this Section 3.2 applies to You and Your Use of the Product: For this EULA, “Compatible Mobile Terminal” means any portable device capable of connecting to the Internet to access the Products. The term Compatible Mobile Terminal specifically covers basic function phones, smartphones, tablet computers and electronic diaries (PDAs).

a) Product Access. In order to use the Product on a Compatible Mobile Terminal, you must have access to an electronic communications network. Connection costs (including without limitation fees from mobile providers and/or carriers) will be borne exclusively by you. You acknowledge that the quality of the products, response time or access to certain functions depends on the capability of your Compatible Mobile Terminal and the electronic communications network. Under no circumstances can Stepbycoin be held responsible for any lack of user comfort. You acknowledge that the Product may not be available on all mobile devices or through all carriers or network service providers.

b Collection of personal data: Stepbycoin may collect and store data about you, your internet connection information and/or information about your Compatible Mobile Terminal in relation to your use of the Product, in order to offer you a better gaming experience, tailored services and Product support. Certain data is recorded, archived, analyzed and used to create user statistics. Stepbycoin attaches great importance to your privacy and will not provide your personal data to third parties unless you expressly consent or in special circumstances. Additionally, Stepbycoin reserves the right to collect, store and use anonymous data about you. For more information about how Stepbycoin uses your personal data, please refer to the Privacy Policy.

c) Analysis Tools and Advertising Services Technology. Stepbycoin uses third-party analytics tools to collect information about You and other users' gaming habits and Product usage. Collected information may include, without limitation: mobile device unique ID or other device identifiers and settings, carrier, operating system, location information, date and time the Product was used, game scores, game metrics and statistics, feature usage, ad conversion rates, monetization rate, purchase history and other similar information. Stepbycoin uses third-party advertising services technologies that may collect information as a result of ad impressions on the Product and display advertisements on the Product for temporary periods. Information collected and used for targeted advertising may include, without limitation: age and gender, number of times an ad has been viewed, mobile device unique ID or other device identifiers and settings, information about your use of the Product, Compatible Mobile Terminal, other websites you have viewed (third party websites pages and mobile websites) (including the date and time viewed), the advertisements served, the location and length of the advertisements in the game, and your response to the advertisements (if any). Analytics tools and advertising services technologies may use server log files, web beacons, cookies, tracking pixels and other technologies to collect such information and may combine information collected on other Stepbycoin Products and services with information collected from other third-party websites, mobile products and services, and demographic, for advertising or marketing purposes and may combine it with other analysis surveys. Independently, this information is not personal data, but if Stepbycoin combines any of this information with personal data, Stepbycoin will treat this information as confidential information in accordance with our Privacy Policy. You can find a non-exhaustive list of the partners whose analytics tools and ad serving technologies we use in our Products at https://stepbycoin.com/user-agreement/. Stepbycoin makes every possible effort to provide You with links to the privacy policies underlying our partners' use of their tools and technologies and, where available, links that will allow you to opt out of those services.

4. MONITORING PERMISSION.

While you are using the Product, the Product may monitor your hardware's random access memory (RAM) for the use of unauthorized third-party programs that interact with the Product, which are prohibited under Section 1. If the Product detects such an unauthorized third-party application, you will also receive information including your Account name, your internet protocol (IP) address, information about the detected unauthorized third-party program and the date and time the unauthorized third-party program was detected, as well as the technical and performance characteristics of your hardware. may be transmitted to Stepbycoin with or without notice. If the Product detects the use of an unauthorized third party program, this License and Your right to access the Product may be terminated with or without further notice to You. Such communications are entirely the responsibility of the relevant user.

5. DISCLAIMER OF WARRANTIES, LIMITATION OF LIABILITY.

YOU EXPRESSLY AGREE THAT USE OF THE PRODUCT IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PRODUCT IS PROVIDED “AS IS” AND “AS AVAILABLE”. Stepbycoin, Stepbycoin's LICENSORS, CHANNEL PARTNERS AND RELATED SERVICE PROVIDERS DO NOT MAKE AND HEREBY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, AS TO: (A) THE SUITABILITY OF THE PRODUCT. CORRECTNESS, ACCURACY, CURRENCY, COMPLETENESS, RELIABILITY OR SECURITY (B) SUITABILITY FOR A PARTICULAR USE; (C) IMPLIED WARRANTIES, SUCH AS PROTECTION AGAINST INFRINGEMENT; (D) MARKET VALUE OR (E) YOUR SATISFACTION. Stepbycoin DOES NOT PROVIDE ANY WARRANTY THAT USE OF THE PRODUCT WILL BE UNINTERRUPTED OR THAT IT WILL BE FREE OF ERRORS, THAT DEFECTS WILL BE CORRECTED, OR THAT THE PRODUCT IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU WILL BE WHOLE RESPONSIBILITY FOR SELECTING THE PRODUCT, INSTALLING THE PRODUCT, USING IT AND THE RESULTS OBTAINED FROM THE PRODUCT TO GET THE RESULTS YOU DESIRE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES SHALL Stepbycoin, Stepbycoin'S LICENSORS, CHANNEL PARTNERS AND RELATED SERVICE PROVIDERS BE LIABLE FOR ANY LOSS OR DAMAGE ARISING IN CONNECTION WITH THE USE OF THE PRODUCT OR ANY RELATED THIRD PARTY SERVICES. IT WILL FALL. THIS INCLUDES, WITHOUT LIMITATION, (A) DAMAGES OF ANY KIND, WHETHER RESULTING FROM TORT (INCLUDING NEGLIGENCE OR BREACH OF LEGAL LIABILITY), WHETHER IN CONTRACT, MISREPRESENTATION (WHETHER OR NOT NEGLIGENT), OR OTHERWISE, (B) DIRECT DAMAGES, (C) IT INCLUDES INCIDENTAL DAMAGES, (D) CONSEQUENTIAL DAMAGES, (E) CONSEQUENTIAL DAMAGES AND (F) INDIRECT DAMAGES.

NOTHING CONTAINED IN THIS SECTION 6 SHALL AFFECT Stepbycoin'S LIABILITY FOR DEATH OR PERSONAL INJURY ARISING FROM ITS NEGLIGENCE, FRAUD OR MISREPRESENTATION, OR ANY OTHER LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. FOR THE PURPOSES OF THIS SECTION 6, Stepbycoin'S LICENSORS, CHANNEL PARTNERS AND RELATED SERVICE PROVIDERS ARE THIRD PARTY BENEFICIARIES OF THE LIMITATIONS OF LIABILITY SET FORTH HEREIN AND MAY HAVE ENFORCEMENT OF THIS EULA AGAINST YOU.

6. INDEMNITY.

You bear all liability for any damages incurred by Stepbycoin, its licensors, channel partners and associated service providers and subcontractors, other product users and other natural or legal persons as a result of your breach of this EULA. YOU HEREBY EXPRESSLY EXPRESSLY EXPRESSLY RELEASE THE Stepbycoin CONTRACTORS FROM ANY SUIT OR THREAT OF SUIT, WHICH IS DIRECTLY OR INCIDENTALLY ATTRIBUTABLE TO YOUR FAULT AND/OR ARISING FROM (A) YOUR VIOLATION OF ANY PROVISION OF THIS EULA (B) OR YOUR USE OR MISUSE OF THE PRODUCT, , DAMAGES AND YOU AGREE TO DEFEND AND INDEMNIFY IT AGAINST DAMAGES AND ALL COSTS (INCLUDING ATTORNEYS' FEES). Stepbycoin reserves the right to assume, at its own expense, liability for the defense of any lawsuit for which you agree to indemnify Stepbycoin. The provisions of this Section 7 shall survive termination of this EULA.

7. CHANGES TO THIS EULA OR THE PRODUCT.

Stepbycoin reserves the right, at its sole discretion, to revise, update, change, amend, add or supplement this EULA, or delete certain provisions for security, legal, best practices or regulatory reasons. keeps it reserved. Such changes will become effective upon or without prior notice to you, as applicable. You can review the most current version of this EULA by clicking on the “EULA” link on the product or ubi.com. You are responsible for checking this EULA regularly for changes. If you find any future changes to this EULA unacceptable or mean that you no longer accept or comply with this EULA, you may terminate this EULA in accordance with Section 8, in which case you must immediately uninstall and remove the Product. You must destroy all copies of the product. Your continued use of the Product after changes to this EULA will constitute your full and irrevocable acceptance of such changes. Stepbycoin may change the Product at any time, at its sole discretion, for any or no reason, in particular for technical reasons such as updates, maintenance and/or resets to improve and/or optimize the Product. You acknowledge that the product may automatically upload or download changes. You acknowledge that Stepbycoin may discontinue supporting previous versions of the Product following the release of an updated version. Stepbycoin's channel partners and associated service providers will have no obligation to provide any maintenance or customer support with respect to the Product. Stepbycoin also reserves the right to amend the Rules of Conduct set out in Section 1 to limit the use of the Product.

8. MISCELLANEOUS MATTERS.

Export Controls. The Product is subject to all applicable export restrictions. You must comply with all export and import laws, restrictions and regulations of the United States or foreign agencies or authorities regarding your Product and your use of the Product. The Product may not be re-exported, downloaded or otherwise exported to or from any country to which the United States has embargoed goods or to any entity or person on the U.S. Treasury Department's Specially Designated Persons or the U.S. Commerce Department's Table of Denial Orders. It cannot be imposed on people who live in countries or are citizens of these countries. You represent and warrant that you are not located in, under the control of, or a national or resident of any such country. Divisibility. If any court of sufficient jurisdiction or authority finds that any provision of this EULA is invalid, illegal or unenforceable, that provision will be deemed to be deleted to the extent necessary and the validity and enforceability of the other provisions of this EULA will not be affected. If any invalid, unenforceable or illegal provision of this EULA would remain valid, enforceable or legal after the deletion of a portion thereof, that provision shall remain valid, with modifications necessary to make it legal, valid and enforceable, to the minimum extent necessary in accordance with Stepbycoin's original intent.

8.1 No Waiver. Any failure or delay by Stepbycoin (or its licensors) to exercise any right or remedy under this EULA or by law will not constitute a waiver of that right or remedy or that such right or remedy or any other right or remedy will be denied in the future. shall not exclude the possibility of its use or be construed as a restriction in this regard. A single or partial exercise of the relevant right or remedy does not prevent or restrict the exercise of the relevant right or remedy or other rights and remedies in the future.
